A By-Election is a special election held between general elections or during the life of a parliament to fill a vacancy in parliament occasioned by: the death of an incumbent; resignation of the incumbent; nullification of the election of the incumbent by a court of law or the recall by the electorate of a member of parliament before the end of his/her term.
After the March 4, 2013 general elections, a total of 188 elections petitions had been filed by the end of the 28-day period after the declaration of results, as set out in the law. In the filed petitions, 24 were challenging elections of the Governor’s seat, 13 of Senators, 70 of members of the national assembly, nine of women representatives, 67 of county assembly members and five of county assembly speakers. From the rulings of these petitions, the elections of Kibwezi West constituency, Matungulu constituency and Siaya County were nullified and fresh elections ordered. The Independent Electoral and Boundaries Commission (IEBC) set October 17, 2013 as the date for the By-Elections in these three electoral districts.
